Please read carefully the below Terms & Conditions and the Passenger Information before you (the Customer) make a reservation and purchase any tours and tour-related products listed on Tours-USA.com for fully understanding your right and responsibility and Tours-USA.com’s right and responsibility. By becoming a customer of Tours-USA.com, you agree that you have read, understood, and agreed with the following "Terms and Conditions", and irrevocable consent to be bound by all said "Terms and Conditions", including any updates thereto. Tours-USA.com has the right to change the Terms and Conditions, in whole or in part, at any time with or without notice. The Tours-USA.com website is controlled by City Travel Limited, registered office Victoria House, 26 Main Street, GX11 1AA, Gibraltar.

1. YOUR ELIGIBILITY

You must be an individual, 18 years of age or older. If you are under 18, you may use Tours-USA.com only with involvement of a parent or legal guardian. Travellers who are less than 18 years old on the departure date must be accompanied by an adult throughout the duration of the vacation.

2. YOUR RESPONSIBILITY

Before making reservation, it is your responsibility to read the fine print associated with your desired product including, but not limited to, the following sections: Pricing and its notice, Tour Itinerary, Package Includes, Package Excludes, Cancellation and Refund Policy, Terms and Conditions, Special Note, etc.. And you herein state that you have read and fully understood the content of all fine print and will waive the right to dispute against any part of it after your purchase.

3. RESERVATION PROCESS

- After submitting your request you will receive our offer.
- Within one or two business days of submitting your reservation you will receive a confirmation email from us.
- A confirmation Voucher will be sent to you providing you with all detailed information about your tour. Contact information for local tour provider will be included on the voucher for your convenience and reconfirmation purpose.
- Simply print your Voucher and present it with your valid photo ID on the day of your activity to your tour guide. Please remember Voucher is your proof of purchase.

4. DEPOSIT AND FINAL PAYMENT

Your booking is not confirmed until the payment is received by Tours-USA.com and you receive a confirmation. Tours-USA.com accepts payments by bank transfer or credit card Visa and MasterCard. Your reservation will be automatically cancelled if payment is not received by Tours-USA.com by the due date.
A deposit of 25% of the total amount per vacation per person is required for Tours-USA.com to reserve space for you.
Final payment is due by bank transfer 90 days prior to the commencement of services. Payment of the deposit indicates you have read and accepted these Terms and Conditions.
If final payment is not received by the due date, your reservation will be cancelled and your full deposit will be retained. Tours-USA.com is not responsible for cancelled land and/or air reservations in the event payment is not received by the final payment date. Payment in full by bank transfer is required at time of booking for reservations made within the final payment date of your vacation (in most cases, within 60 days of departure). For group reservations special payment conditions may apply.
Acceptance on the vacation is subject to presentation of the Confirmation Voucher, which will be available in your final Travel Documents.
Tours-USA.com takes every precaution to protect your security. In order to protect you against credit card fraud, we require for payments by credit card additional documentation if one of the following applies to your purchase:
- Credit card holder is NOT one of the guests who will join the tour or
- Your billing address can NOT be verified by our system or
- Credit card transaction amount is over $1000.00
We require the following supporting documentation:
- A photocopy of the credit card holder's photo ID (valid photo ID includes US-issued Driver's License or US-issued Photo ID or National Passport with signature page)
- A filled-out and dated Acknowledgement of Card Billing Form signed by credit card holder.
- A copy of guest's passport if credit card holder is NOT one of the guests who will join the tour.

5. PRICING, AMENDMENT, CANCELLATION AND REFUND POLICY

Please be aware all prices are offered in the currency of United States Dollars or Canadian Dollars for certain tours in Canada. Prices may vary due to availability. For example, prices may increase during holidays. All prices are subject to confirmation. Prices are subject to increase without notice.
Your purchase will initiate a reservation process. The cancellation fee will take into effect once you submit your reservation. If your purchase can not be confirmed for any reason, we will fully refund your purchase without any additional charges. We recommend each customer to fully evaluate the cancellation policy and also to purchase a "Cancel for Any Reason (CFAR)" Travel Insurance. All hotel and tour schedules are arranged ahead of time. Any person failing to appear on the day of departure shall not be refunded.

The Cancellation Fees listed here will apply to all reservations, unless the tour booked has specific rates or fees listed under "Special Notes".
No refund shall be given for any portions of the tour unused by the customer after the departure of the tour regardless of any possible reasons.
For tours that include airfare, airfare is completely non-refundable.
Hotel extension is non-refundable once it is confirmed.
We do not accept changing tour departure date if departing within 60 days.
All cancellations must be made directly with Tours-USA.com.
Some tours may require a minimum number of people to operate. The affected customer will be fully refunded or may choose a similar tour product as a substitute. However, please keep in mind that should this happen, it would be under very special and rare circumstances, because we will try our best to accommodate our customers' travel needs.

Amendment Fees: for any changes (date, departure location, tour, etc.) made on a reservation after a confirmation e-mail has been sent out, the reservation is subject to a $500 amendment fee per change.
The amendment fees will apply to all reservations, unless the tour booked has specific terms, fees and conditions listed under "Special Notes". Cancellation Fees will apply to any reservation with a travel date within 90 days.

If you would like to add an additional passenger onto a reservation after it has been confirmed, we will only charge the difference in rates for the added passenger. Once the added passenger has been confirmed, the reservation cannot be changed or removed without a Cancellation Fee. To cancel a customer from a reservation, the regular cancellation policy will apply.

6. CHARGEBACK

You hereby waive any objection you may have to Tours-USA.com’s use of electronic records with MasterCard and Visa or banks that issued credit cards should it be necessary for Tours-USA.com to respond to a chargeback. You agree that Tours-USA.com does business electronically by email, so email is accepted as the form of delivery of the services provided by Tours-USA.com. You are not ordering tickets to be delivered in person or by mail, so you agree to accept email as the form of delivery and instructs MasterCard, Visa and banks that issue credit cards that email delivery constitutes delivery of services in this transaction.
You agree not to dispute a credit card charge on the basis of services not rendered if Tours-USA.com can prove that the Voucher was sent by email (by providing electronic proof that the Voucher was sent at a specific date and time as recorded by Tours-USA.com's computer system); by fax (by providing a copy of the transmission record showing the fax was successfully sent to the fax number provided); by mail (by providing a signed statement by the person who deposited the Voucher in the Postal Service or Courrier). You agree that you will not dispute any charge improperly. This includes filing chargebacks claiming fraud if you claim the name of Tours-USA.com was not recognized by you. In the event you file a chargeback improperly, you agree to provide a written statement to the credit card company confirming the charge is correct and should be paid and agree to send a copy of this letter to Tours-USA.com.
In the event legal action is necessary for by Tours-USA.com to collect money taken away from Tours-USA.com through a chargeback or to collect the Chargeback Fee, you agree to pay Tours-USA.com’s legal expenses if Tours-USA.com wins the lawsuit.

7. TRAVEL INSURANCE AND LIABILITY

Tours-USA.com strongly recommends customers to purchase a "Cancel for Any Reason (CFAR)" Travel Insurance. Tours-USA.com does not currently offer any travel arrangements. The tour products listed on Tours-USA.com are operated by independent tour providers. We act as agent for providers of tours, transportation, sightseeing and hotel accommodations. Tours-USA.com shall be exempt from any liability in the event of an accident resulting in, but not limited to, loss or damage of properties, injury to people, death during trip, delays, irregularities or other occurrences beyond its control. Settlements will ensue in accordance with rules set by airlines, hotels, buses, etc. You agree that Tours-USA.com will not be liable for any costs or damages arising out of a dispute or disagreement between you and any participating provider or a third party for any thing which is in any way related to this site or the use of information contained in this site, and you hereby expressively waive any such claim against Tours-USA.com and its owner, members, officers, directors, employees, parents, subsidiaries, agents and representatives.
Tours-USA.com believes that due to the Cancellation Policy for your tour and the unexpected events that can possibly occur, your party would benefit from purchasing Travel Insurance for your reservation.

8. FORCE MAJEURE CIRCUMSTANCES AND LIABILITY

Any failure to perform, delay, liability or damage shall be excused and Tours-USA.com shall not be held responsible for the consequences of Acts of God, labour disputes, civil commotions, fire, weather conditions, theft, unavoidable accidents, war, terrorism, threatened acts of terrorism, epidemic, pandemic, travel ban, visas ban, acts of state or agencies thereof, or any other circumstance beyond the control of Tours-USA.com. No refund will be given in such circumstances.
Tours-USA.com shall not be liable should it be required to change an itinerary or individual booking, hotel accommodation or other services necessary for the safety and continuation of any tour or passenger or due to unforeseen circumstances beyond the control of Tours-USA.com.
Tours-USA.com does not manage, control or operate any transportation vehicle, hotel or any other supplier of services, and therefore assumes no responsibility and shall not be liable for injury, loss or damage, accident, delay or irregularity which may be caused through any defect in any vehicle or through the acts or omissions of any company or person engaged in supplying products or services.

9. TOUR AMENDMENTS AND CANCELLATION

Tour providers will try their best to make sure all the tour arrangements will be the same as planned. However, to ensure safe and secure tours, tour providers reserve the right to make amendments including altering, postponing and cancelling tours due to weather, transportation, riot and many other uncontrollable reasons under very rare and special circumstances, such as an epidemic or pandemic, travel ban, visas ban. Tour providers also reserve the right to cancel the tour prior to departure, if the number of participants is inadequate to form a tour group.
Tours-USA.com is not responsible if an airline cancels, reschedules, or delays a flight for any reason. If you miss your departure flight, it is your responsibility to work with the airline on which you are ticketed to reach your destination. Tours-USA.com is not responsible for any additional expenses you may incur prior to joining your trip. Tours-USA.com is not responsible for and will not provide any refund for portions of trips missed due to canceled, rescheduled, or delayed flights.

10. VISAS AND PASSPORTS

You are responsible for obtaining and paying for all visas and entry documents, for meeting all health and other requirements, and for any documents required by the laws, regulations, orders, and/or requirements of the countries you will visit. Non-U.S. citizens must consult with appropriate consulates to determine if any visas are needed and are responsible for obtaining all visas and entry documents independently. Tours-USA.com is not responsible for providing you with specific visa and passport information or documentation, and Tours-USA.com cannot accept liability for any passenger refused entry onto any transport or into any country due to failure of the passenger to carry correct documentation. All passengers travelling internationally are required to have a passport. It is your responsibility to verify all visa and passport requirements. You are responsible for any expenses incurred as a result of delays or itinerary changes related to your lack of appropriate travel documents. Tours-USA.com will not be responsible for any penalties due to your failure to abide by any regulations of the government of the visiting country.

11. PARTICIPATION

For the benefit of everyone on your vacation, Tours-USA.com and its providers reserve the right to accept or reject any vacation participant and to remove any participant whose conduct is deemed incompatible with the interests of the other participants. Tours-USA.com will not refund or cover any cost or expenses incurred for termination of vacation arrangements due to unacceptable behavior.

12. LANGUAGE

Tours are escorted by professional English or bi- or multi-lingual tour guide and/or driver guides. In order to meet the language needs of the majority of passengers on a tour coach, tours and/or languages may be combined to enable operation of the tours. You have the responsibility to inform us of your language needs when you book the tour online.

13. MEDICAL CONDITIONS, PREGNANCY AND TRAVEL

If you have a medical condition, or if you are pregnant and considering travel, you must consult with your doctor before you travel, especially if medical condition requires daily routine care, urgent care, or your pregnancy is high-risk. You are responsible for disclosing any related information to us during the check-out process by adding special comments. You understand Tours-USA.com or local provider is not in a position to provide any medical services or urgent care in the event such an action may be required. You are liable for any risks, incidences or consequences incurred during travel. We highly recommend that you purchase medical insurance and travel insurance before you travel.

14. DISABILITIES AND TRAVEL

We embrace all people, regardless of colours or physical conditions. One of our goals is to provide free access and expand travel opportunities for people with special needs in the United States and abroad. We are exploring more travel products to accommodate this special population; however, yet, not all the travel products we currently offer include special accommodations. You are responsible to verify with us before you book travel to ensure that special arrangement can be made if it is required for your needs. Tours-USA.com or local provider is not liable for any incidences or consequences incurred during travel or complaints or lawsuits during or after travel due to your failure to inform us of your special needs. You also have the responsibility to re-confirm with us, after we reserve seats for you, that special accommodation will be provided per your request.

15. SAFETY

Please be aware that during your participation in vacations operated by Tours-USA.com, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of travelling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities. Tours-USA.com will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. While Tours-USA.com will use its best efforts to ensure the adequate measures are taken, by agreeing to participate in a tour and/or optional excursions you agree that you will hold Tours-USA.com harmless regarding any provision of medical care or the adequacy of any care rendered.

16. COMPLAINTS

If you have a problem during your holiday, you are required to immediately inform the relevant supplier and the escort/representative will endeavour to put things right. If the complaint is not completely resolved locally, please follow this up within 7 days of completion of services by writing to Tours-USA.com, giving your original booking reference number and all other relevant information.
As it is difficult and sometimes impossible to properly investigate a complaint if Tours-USA.com and local providers are not advised of such complaint quickly, any compensation you may have been able to claim could be reduced or even forfeited if you do not follow the complaints procedure set out in this clause.

17. PRIVACY AND DATA COLLECTION

Tours-USA.com is the sole owner of the information collected on this site. We will not sell, share, or rent this information to any outside parties, except as outlined in this policy. Tours-USA.com collects information from our users at several different points on our website in order to process reservations and better serve you with pertinent information. Information collected includes name, shipping address, billing address, telephone numbers, e-mail address, and payment information such as credit card.

18. DISCLAIMER AND LIMITATION OF LIABILITY

Tours-USA.com uses reasonable efforts to include accurate, complete and current information. We do not, however, warrant that the content herein is accurate, complete, current, or free of technical or typographical errors. It is the user's responsibility to verify any information before relying on it. We reserve the right to make changes and updates to any information contained within this site without prior notice. Access to, and use of, this website and the content thereof is at the risk of the user. In certain instances we have provided links to other web sites solely for your convenience. These sites are not maintained or controlled by Tours-USA.com, and we are not responsible for their content. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, bugs, worms, cancelbots, trojan horses and other items of a harmful or destructive nature.

Many of the trademarks, service marks, and logos (collectively, the "Marks") displayed on this Web site, including "Tours-USA, Tours-USA.com" are registered and/or unregistered Marks of Tours-USA.com. The Marks of third parties may also be displayed on this Web site. Nothing contained in this Web site should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Marks displayed on this Web site without the express written permission of Tours-USA.com or any third party that may own the Marks displayed on this Web site. Any unauthorized use of the Marks or any other material, except as authorized herein, is strictly prohibited.
Under this Agreement, Tours-USA.com gives you permission to access and use the Services for your personal use, and to copy, distribute and transmit the content of the Services only to the extent that such copying, distribution, and transmission is automatically done through your browser software incidentally to using the Services for your personal use. 20. CHOICE OF LAW, WAIVER, AND CLAIMS

This Agreement shall be governed by and construed in accordance with the European laws, without reference to conflicts of law rules. As a condition of the use of the Tours-USA.com website and services, you (the Customer) agree to submit to the personal and exclusive jurisdiction of the courts located within Europe and therefore agree to file any grievance or suit of any kind exclusively in the courts located within Europe. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. Tours-USA.com’s failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between Tours-USA.com and the product providers or between Tours-USA.com and any other of its Corporate Partners. Neither the product providers nor any Corporate Partner shall have the ability to create any obligation on Tours-USA.com’s behalf. This Agreement constitutes the entire agreement between you and Tours-USA.com with respect to the using Tours-USA.com.
